Tier 2 Fresh apply

Hi my previous visa are

​TIER2 ICT ESTABLISHED STAFF ( april 2011 till -april 2012 )- Applied from home country
​TIER2 ICT LONG TERM(june 2012 till -may 2013) - Applied from UK

my inland tier 2 visa renewal from UK on may 2013 was rejected saying i didnt meet the minimum threshold salary of 40600
I appealed against the decision from UK stating since i got the establised staff visa on april 2011 i dont have the meet 40k

My appeal was rejected on dec 2013 and i returned back to india
Reason for appeal rejection:
"the appelllant doesnt satisfy the requirements of the rules because , contrary to what he claims on appeal , the last leave to remain granted on 14june 2012was a tier 2 long term migrant was valid until 14may 2013 which concurs with the reasons for refusal letter.Accordingly he was required to satisfy the requirements in appendix A relating to appropriate salary and requires 40600"

i returned back to india on dec2013 since i didnt want to go for second appeal.

i applied for business visa from india and got valid from may 2014 to october 2014
My question here is am i eligible now to apply for a short term or long term visa or should i need to wait for another 1 year starting from dec2013 (when i returned to india after my appeal was rejected) or starting from may 2013(when my actual long term visa got expired)

A.currently i am in india , i am eligible to apply for ict long term without waiting for cool off , since i was in established staff category?
B.Is the appleal period also needs to considered for calculating cool off ?

cooling-off will end in Dec 2014. This is because you had valid leave under section 3C until the appeal was rejected in Dec 2013.

then i thinik i dont need to wait for cooling period

the appeal is now history, at present you don't have valid T2 leave therefore cooling-off applies.

unfortunately this doesn't apply to you because your last leave was T2 ICT Long Term Staff, not Established Staff.
