complication between tier 1 entreprenuer appeal and tier4

Hhi guys,
Me and my dependant withdrawn our tier1 entreprener appeal from upper tribunal and made tier 4 fresh application. BeI confirmed by phone call that our appeal has been withdrawn by tribunal and they sent out letter as well. But before I recive the letter I made fresh application and mentioned in cover letter of tier 4 application. As a withdrawn evidence isubmitted the fax reciept and withdrawn requesting letter what I sent for withdrawn. Some1 said my application still will be invalid as I didn't get confirmation letter before tier 4 application. Spoke to 1 solicitor and he said the application will be valid.

It's been 1 week didn't recive anything from ukvi. Some of documents was already with the home office and I mentiined it in cover letter.
Whar could the response from ukvi about validity and how long they take for biometric enrolment letter.

Please gurus out me from this stress. Please

I think I made the post very complicated. Here is clarification...

1) I withdrawn my appeal and made a tier4 fresh application. But I did not submit appeal withdrawn confirmation letter with tier 4 application as I applied before recieve the letter from tribunal. But before I make fresh application I did call to tribunal and found out that appeal already withdrawn. I did not wait for the confirmation letter cause my bank statement was going to older than 31 Days. IN THIS CASE MY APPLICATION IS VALID OR UNVALID? PLZ UPDATE
