Which visa category should I apply for my daughter.

Post by amb24 » Fri May 02, 2014 5:17 pm

Hi
My daughter was born in UK.
I am on tier 1 visa and my spouse is on Tier 1 dependent visa.
I did not get her any UK visa after she was born. Now my daughter along with my spouse is currently in India for short visit.
I will be eligible to apply for ILR in the first week of June.
Which visa should I be applying for my daughter ?
Is it possible that I can apply visit visa for her to come to UK and then apply ILR for her along with myself in June. Essentially that will be ILR application for 1 main applicant + 1 dependents. Will I be able to register her as british after I get ILR?

Thanks

As your daughter was born in the UK she is entitled to be registered as British by section 1(3) BNA 1981 as soon as you are granted ILR. You can do this in the UK whilst the child is abroad on form MN1 and can use the NCS to assist.

Thanks for your reply Amber!
But I prefer to have her and my spouse back ASAP, as I do not know the processing times of the application. In such a case, can she come to UK on a visit visa and can I register her as a British citizen after I get ILR. I am planning to use same-day service.

Child could be given Entry clearance as a PBS dep in line with Mother.

Is it not possible to get her here on a visit visa and then register her as British. A dependent visa costs much more that a visit visa.

Can I apply for her together with my ILR application while she is abroad, and I am in UK.
