Non-EU De facto & UK citizen - Schengen visa

Post by tjw101 » Sat May 03, 2014 6:31 am

Hi All,

We read that there are different rules for Schengen visas when dealing with a mixed nationality couple.

Our Details:

One British Citizen (Now also an Australian Resident.)
One Australian Citizen

I successfully attained Australian residency which required us being acknowledged as de facto partners in Australia. The documentation confirming my residency has my partner listed as "sponsor" though. I'm not sure if this is the right wording to be useful as a proof of de facto status.

We intend to travel through Europe (probably not looking to work at this time) and my understanding is that, ordinarily, an Australian Citizen can stay for 3 months out of every 6 months only. But, if travelling with a spouse, the situation is different?

Our questions:

1. What documents would be required for us to prove we are a de facto couple - we don't have a certificate and not sure how we'd go about getting one.
2. Is Australian De Facto partnership recognised in EU countries as a civil partnership?
3. How long would my Australian Partner be able to stay in Europe If I am accompanying her?
4. Does she have the same rights to just turn up at the border as I do? Or would we have to apply in order for her to be able to stay longer than 3 months?
5. In case we did decide to take up some casual employment, would she have any rights to work, being my spouse?

Many thanks in advance :-)
