problem with garda

Post by zaza7625 » Sat May 03, 2014 6:51 pm

Hi everyone
Yesterday I had a problem by my silly mistake and I have been cautioned by garda called adult caution.
When i asked them ,will this case be reflected upon my further application of citizenship after 5 years,he replied no but i am not 100% sure about that.he said that this is only an adult caution not sending me to court.
Did anyone go through this and any suggestions about it?
I'll be very grateful
Thanks to everyone who replies me

I'm facing the same here, read my post and comments. The Gardai told me the same but the problem is that I heard that INIS request for your background check from you local district and since its kept there and also on police national computer database, won't they sees it and decided one isn't of a good character?

So, I didn't understand, the adult caution is a problem for getting citizenship or no?
In case If I have a adult caution, do i still have an opportunity to get irish citizenship?
Thanks

It depends on what constitutes Good Character, in the case of British citizenship a caution is treated akin to a non-custodial sentence. I'd need to look at the guidance for Ireland. 40% of refusals are based on character according to one source I read! this would indicate a tough policy. However, I'd need to see any guidance.

All I've found is:

A. Good character means that you show respect for the laws of the State. In this regard vetting and background checks will be conducted. This will involve enquiries with An Garda Síochána and enquiries may also be made with other agencies.
You must give details of all criminal convictions both within and outside the State in the relevant section of the application form, including road traffic offences. You must provide details of any offences for which you have been arrested but have not been formally charged. Please note that if you are arrested or charged with an offence after you have made your application you must inform the citizenship section of it.
In relation to questions 11.9 and 11.10 on Form8 or 10.9 and 10.10 on Form11, if you do not regard something you have done as an act of terrorism but others do or might, you must include details of it in the ADDITIONAL DETAILS section.
If you have failed to disclose any material facts then your application is unlikely to be successful.

I can't seem to locate their guidance, can anyone else?

A caution is not a conviction.
