ILR - 5 months break outside UK

Post by Sammy007 » Sat May 03, 2014 9:02 pm

Hi,

First of all thanks for taking time to visit my post and I really appreciate your help on this.

I am wondering if I pass the ILR 5 year continuous period criteria. I have gone through various posts regarding the same, but unfortunately I still have some confusion regarding my case.

I have Tier 1 Visa. First Entry: 3rd March 2009 through Tier2 but applied for successful Tier 1 application on 27th March 2009 and then extended Tier 1 from there on.

Here is my absences during the last 5 years:

9th Aug 2009 - 2nd Jan 2010 (146 days) - I went back to India to continue the job from there. Returned to UK on 2nd Jan.
26 july 2012 - 8th aug 2012 ( 13 days holidays in India)
1 Nov 2012 - 18 Nov 2012 ( 17 days holidays in Australia)
4th dec 2013- 13th Jan 2014 (40 days holidays in Australia)

I am not sure if I need to provide any evidence for the absence. section 6.2-6.3 seems to say this, but may be I am interpreting it wrong because various members in different posts have said no evidence is required for Tier 1 (G).

I can get the letter for the holidays, but I am not sure about the 146 days absence. Partly the reason was I wanted to visit my family and it worked for me to work from the office in India. Do I need to show any evidence for the absence for 146 days?
The other option for me would be to wait till Dec 2014, which I am trying to avoid.
Any help would be really appreciated.

Thanks

Absences should be <180 days per 12 months, if you're attending a PEO it's unlikely you'll be asked for evidence.
