Hi,

I was on student visa till 28th feb 2007. I applied for HSMP on 22nd feb 2007, as my visa was getting expired i applied for FLR (IED) and sent my passport to homeoffice under which i can stay in UK even my visa is expired till my process continues. HSMP was rejected in march, i applied for reconsideration but it was rejected even for the second time. So, i withdrawn my FLR(IED) i.e., Passport from homeoffice on april 17th 2007. As soon as i got my passport i applied for SEGS from my university on 4th May 2007 as i m eliglible for SEGS for my course. I got a letter from homeoffice on 12th july stating that my application is valid but needed further enquiry. Unfortunately on 2nd july SEGS was rejected, reason was my visa was expired on 28th feb and they are not happy with this and they sent my passport to local enforcement office. I was served with form IS151A on my passport at airport.
I m still eligible for SEGS and i want to apply for it from India but i m scared all this may effect getting me visa.
Can anyone please help me what to do, how to approach my case or should i appeal through lawyer.
Please let me know if anyone knows any good lawyer who deals such cases in hyderabad.

You have been deeply, deeply unlucky.

The answer is that even if you are approved for SEGS (or IGS) then you still run the risk of being refused for entry clearance. You'd have a good chance of winning an appeal but this may take some time.

If you apply anyway, I suggest that you explain exactly what has happened. It sounds to me as though you should not really have been removed - that was harsh - and a reasonable ECO will agree.
