Hi there

I am hoping to apply for a marriage visa for my husband, however I currently live with my mother in a council house. I am working and am not in receipt of public benefits, however she is in receipt of disability living allowance and income support. Would I be able to apply for a spouse visa living at this address? Also before applying for the spouse visa I would like to apply for a visitor visa-again, could my husband come on a visitor visa if we were based at this address for the duration of the stay or would it constitute 'accessing public funds' as the rent is subsidised by the government as my mother is on benefits?

The Council as the landlords would have to agree in writing to your husband joining the household. I'm assuming that are aware that your are also living in the property? What does your mother's rent book say about additional people living there?
Staying as visitor wouldn't be considered as accessing Public Funds.
