Hi, I'm new to the forum & would welcome any advice you can give.

I am currently in the UK on a work permit (I arrived in May 2004 on a management graduate 60 month work permit & then in November 2004 changed companies & my work permit was transferred). I have been offered a new job in a different company and they have advised me that I will have to go back to the US for 2-3 weeks to wait until the new work permit & entry clearance come through. The consultants they use are the same who processed my previous 2 permits and have advised them of this. The new position is in the same industry (hotels) but is quite a different position. So, will I have to give notice at my current job (one month) and then after that month go back to the US? Do you know if there is a way to do this so that I can remain in the UK?

If it is a change of employer with similar type of job/role/position, then it will be a change of employer approval type work permit with residency market check waived.

However, it the new role is too different from the exisiting one, then you need a fresh work permit application with proof that employer couldn't find someone in EU to do same job. Often requires 3 months ad in job sites etc.

AFAIK, in none of the above cases, a WP holder is required to leave the country.

The role is different from my current role although in the same business (hotels). The new company checked with 2 different work permit consultants who both said it would be nearly impossible, so they've rescinded the job offer. I don't see that it says TWES on it anywhere, but I guess that must be what it is.

I'll be eligible for the Unmarried Partners visa in November so will just have to wait until then. Til then, am stuck in current job. Boo!!!!! :(
