please help!!, advice needed

A friend referred me to this forum with hope to get advice from kind people on here. i have just got news about the death of my father, i am veryyyyy sad and need to travel.. the problem is that i have just gone through a divorce.

this is my story...
i'm a non eea national, recently divorced from ex spouse about a month ago. we got married in may 2010 and divorced march 14 (decree absolute). my current RC is valid till Nov 2015.

my intention is to apply for ror as i still have about a year before PR.

my ex husband and i lived together all through the marriage till problem started (basically lived together for just over 3years). non-eea is in self-employment and still in, while i am in employment and still working. we had an amicable breakup and still friends. i have all my ex treaty rights documents from beginning (when we were dating) till the time of divorce. which is over 5years of treaty documents(these are SA forms,SA statements with payment receipts, invoices to customers, NI statements with payment receipts, letter from his accountant)

i have now recieved news about my fathers death, i need to travel to the burial, i dont know what to do, i am helplessss..
i have been in talks with my family back home. I CANNOT miss my daddy's burial, its bad enough i wasnt by his bedside when he was critically ill. my family is planning burial in about 3 month to enable everyone time to return back.

i need advice on way forward. can i put my ROR application on hold and travel with my current RC then apply for PR come may(i say apply for PR bcos by the time i return, i will only have months left before PR). will i have problems entering back into the country?

the other option is to persuade my family to move the burial towards end of the year to enable my apply for ROR , but then what guarantee do i have that i will have my RC back by then.

please advice me.. my head is spinning round.

change date of burial end of the year just because of immigration issue? Family is everything. Family more important then anything else.

- You can send EEA2 application now and hopefully they send you new residence card before 3 months

- You travel with your current visa and travel back. UKBA won't know if you are still married or divorced unless you or your ex wife tell them ( it's risky but i know people travel ). Then when you come back in the Airport UKBA immigration office may ask you question where your EEA national is and what she doing. 90% of the they will believe what ever you say and they won't investigate

- Travel with COA that you receive after sending EEA2 application for ROR and show it to the immigration officer. If your case is not decided / successful by then they will let you in but you have to ask for your passport back so residence card will be issued in A4 size paper

if your case is unsuccessful ( decision made ) before you arrive in the UK airport then you will be entitled to an in country right of appeal

Many thanks for your advise. I have my RC on A4 now though. I worry that if I put in the application and request my passport back. They wouldn't return my RC .

I like option B..A would have been great, but I don't know what the processing time is like now. Unless anyone else thinks otherwise

Can I ask please. If I decide to travel with my current RC, and then return with it. Should I apply for ROR or wait till PR in May 15. And will there be any negative impact.

Oh i see. Just tell them you need both back

You can send ROR and later apply for PR . it's just £55 + £55 or wait till PR date
After divorce it's better to apply ROR straightway but some people don't
