Many thanks for your advise. I have my RC on A4 now though. I worry that if I put in the application and request my passport back. They wouldn't return my RC .askmeplz82 wrote:Sorry for your loss. May he rest in peace

- You can send EEA2 application now and hopefully they send you new residence card before 3 months
- You travel with your current visa and travel back. UKBA won't know if you are still married or divorced unless you or your ex wife tell them ( it's risky but i know people travel ). Then when you come back in the Airport UKBA immigration office may ask you question where your EEA national is and what she doing. 90% of the they will believe what ever you say and they won't investigate
- Travel with COA that you receive after sending EEA2 application for ROR and show it to the immigration officer. If your case is not decided / successful by then they will let you in but you have to ask for your passport back so residence card will be issued in A4 size paper
if your case is unsuccessful ( decision made ) before you arrive in the UK airport then you will be entitled to an in country right of appeal

You can send ROR and later apply for PR . it's just £55 + £55 or wait till PR date
After divorce it's better to apply ROR straightway but some people don't
