Hi All,

I will be completing 5 years in UK around June/2014 and am planning to apply for ILR. I am on Tier 2 (ICT).
I have following questions for my eligibility for ILR-
1> During these 5 years, I have been out of UK twice and both were for two weeks each. Do I need letter from employer for these breaks? BTW, these were paid annual leaves.
2> I recently observed, that during one of the extension of my Certificate of Sponsership (CoS) there is a gap of 15 days between the end date (of old) and start date of new certificate. However, the corresponding Resident Permit card (for the old cert) was till the start date of the New CoS. Is this an issue? These extensions happened within UK.

I am new joinee here and any expert advice is welcomed.
I tried searching through forums but was not able to get similar case.

Please help.

1. yes, the sponsor should certify all absences incl. annual leave

2. did you work in the 15 day period between the work end date in the old CoS and the work start date in the new CoS? Was there a gap between the end and start dates of the old and new BRP's?

I think during this gap I took the annual leave.
There is a gap of 1.5months between the old and new
BRP cards. Is this an issue?

you were not supposed to have worked during the 15 day gap between the end date of the old CoS and the start date of the new CoS - if you didn't there is no problem. The gap in the BRP card dates is not an issue because BRP cards are dated when they are actually issued (they are not backdated)

Thanks for the reply, I just checked. This 15 days were not during my annual leave.
I was sitting at home as company was working out my next assignment. I got paid during this period but was not on leave as such and was not working either.
Do I have to prove that I was not working during this time?

the HO may or may not pick up the 15 day gap and may or may not question whether you worked in that period. However, It would be advisable to have a letter available from the company confirming that you didn't, just in case there are questions asked.

Thanks a lot for the reply, it helped a lot.
One more query, I have two kids (dependents, not UK born). While applying for ILR for myself and my spouse, do I have to apply for them as well or is it better to wait for our ILR and then apply for kids UK registration for citizenship?
I tried searching the forums but most of them are about kids born in UK cases.

Hi,

I am very near to applying for ILR, till now I was under the assumption that I don't need to give English test.
I have done MCA from an Indian University and the degree is in English as the course itself was taught in English.
Do I need to give the test? In one of the PDF from UKBA, I read ICT holders do not have to give the test.

Please help ASAP.
