spouse visa application when claiming carers allowance

Post by melissaluka » Mon May 19, 2014 11:24 pm

Im sorry if this has been done before or if i am posting in the wrong place.
I am a British citizen married to an Albanian citizen, we have a 7 month old son who holds both british and albanian passports, my husband and i have been together since 2012. I have spent the majority of the 2 years living in albania with my husband with solo trips to the uk. Our son was also born in albania. we have applied for 3 visit visas which have all been declined due to not having enough proof my husband will return home.
I returned home in April as my disabled mother now requires full time care. I have applied for carers allowance and this has been granted i have had 2 payments since application. I also work 8 hours a week at national minimum wage. all togther my weekly income is as follows:
C/A 61.25
CHILD TAX CREDITS 63.00
CHILD BENEFIT 20.80
WORKING INCOME 50.64
INCOME SUPPORT 2.00

could you please tell me if i earn enough money to prove adequate maintenance for myself my husband and son?

we will be living with my father free of charge for the duration of the visa

this is my proposed list of evidence for the visa:

proof of relationship;
marriage certificate albanian and british
all photographs of us over the last 2 years in various places and with various family members,
facebook and skype screenshots
viber screenshots
letters and cards sent between us both
sons birth certificate and albanian medical records
letters from my mum and brother (who is good friends with spouse) and spouse's brother who lived with us for 3 months.
flight tickets and from albania
copy of entry stamps to albania
letters from sponsor and applicant detailing relationship history and future plans

proof of adequate maintenance:
carers allowance letter from dwp
tax credits letter
child benefit letter
payslips
work contract
letter from boss stating that my job is secure and a personal reference
bank statements for one month showing carers allowance payment, tax credits payment, child benefit payment,
wages.
payslip
expenditure breakdown

proof of adequate accommodation:
letter from father stating that we can live at his house free of charge for duration of visa
land registry documents showing ownership
an immigration report from either council or estate agents proving no overcrowding
photographs of rooms in house

additional info:
applicants passport,
2 passport photos
english language test certificate
photo copy of my passport bio page
my birth certificate

have I included enough evidence to grant the visa? also i am currently living with my mother but will be moving to my fathers so all officail documentation is in my current address, should i change them all to my fathers address?

thankyou for reading and thank you for any advice you can offer.

Do the calculation as per - Adequate maintenance: Calculating after April 2014 (click).

Do you live with your Mother?

hi amber, thanks for your reply.
from what i have read i should be able to prove adequate maintenance.

yes i currently live with my mother but believe that it would be classed as over crowded with my husband.

thank you again for your reply,
my mums house had 3 bedrooms and 2 bedrooms if my spouse was to move here there would be 6 people and a baby under 1. my mum and step dad, my sister, brother, me spouse and our son. I believe having read the link that we would not be overcrowded but as my mother rents and father owns I thought it would sit better in the application if we lived there. both parents are happy for us to stay at either house.
