Switching from Tier 2 (ICT) Long Term to Tier 2 (Gen)

Hi

There is a person who has entered UK on Tier 2 ICT Long Term visa in Oct 2010. He wants to change employer in UK. Can his visa be changed to a Tier 2 (General) by the new company?

If yes, can the switch be done while staying in UK?

I guess he can switch the visa to Tier2 General with in UK as the Tier2 ICT visa granted before Apr 2011.
However the stay on Tier2 ICT visa will not count towards ILR and he need to spend 5 years on Tier2 general to get ILR.

In that case, if the employer sponsors his Tier 2 General visa, do they have to conduct a resident labour market test first before generating the COS?

Yes,
They need to conduct RLMT for you if the job is not falled in shortage occupation list..
The sponsor will decide based on the job role (SOC code)
