ILR Set(M) adequate finances query?

Post by Ninkynonk » Tue May 20, 2014 1:53 pm

Hello...

I have a PEO appointment for 2.06.2014, applying for my wife's ILR set(M). Reading through the other posts I am worried now. I have two children born in uk with British passports. My worries are more about my financial situation.

I was not aware of the changes that came in April. I have done the calculations and according to that I am under the £263/week but have £5000 in saving. What are my chances? I am on benefits; working tax credit, child tax credit, child benefit and housing benefit.

Savings will help, set out your income and rent/council tax.

Income = average £500 PCM (fluctuates)
Rent = 1100
Council tax= £18
TC+CTC= £820pcm
Child benefit= £135
Housing benefit= £754

My parents from time to time send us money, should we include this in section 8? We don't have any evidence to show because it's usually cash. My sister in uk helps us whenever we need extra and this is usually online transfers which we can show in bank statements. It isn't regular so I am not sure if I should mention it in the form.

The £5000 was transferred in my account last month by my parents from overseas.

Assuming you have one child it seems ok.

Then should child benefit not be £147.55 or if your figure 4-weekly?

It is 136.20 PCM.

I came under the old rules(pre-July 2012) and was on a 27 month spouse visa.now applying for indefinite leave to stay. So do the new rules including the adequate maintenance of finances apply to me ?

Adequate maintenance is not a new rule, the new rule is a Financial Requirement.

Please do try and calculate this as per Adequate maintenance: Calculating after April 2014 (click).
