Cooling off period

Post by tgr75 » Sun May 18, 2014 10:53 pm

Hi all,

I came to the UK in a Tier2 Intra-Company visa on the 19-Feb-2011, first visa was til Jan-2014. I got an extension on Dec-13 until Jan-15. Does the cooling-off period apply to me if I want to extend my visa? Because I entered the UK before the change of law on April-12, however the visa renewal was after.

Any help very much appreciated.

under current rules you can apply for any number of extensions if you have a CoS and if you do there is no time limit on your stay in the UK under T2 ICT. Cooling off only applies to entry clearance applications, not for leave to remain.

Hi Manci,

I was in UK from Jan 2012 till April 2014 under a tier 2 ICT long term Visa with family. My current COS was supposed to be valid till 30th Sep 2014 and current visa is valid through Oct 2014. However Since I returned back home, my COS was cancelled.
I now have a travel proposed for a 'new' assignment back to UK. I need to urgently understand what are my options to travel back?

1- If my COS is cancelled , does it mean i cannot use the Visa that was issued on that COS for my travel and have to serve a cooling off?
2- Can I still get a new COS issued and travel back on the same Visa ? If not, can a new Visa be issued again under a new COS?
3- If iam performing a similar role ( as in my previous COS) , can a new COS/Visa still be issued ?
4- Can the visa type be changed ( Tier 2 ICT to Tier 2 general-same employer) and travel be possible?

Request your urgent help.

Thank you for your reply manci,

If I change of position within the company, can my company issue a new CoS without any problems?

Thanks again.
