Tier 2 General

All,

I am currently on Tier 2 visa and COS is through an Indian company. My role is an onsite one so I am working at client's location here in UK. However client is interested in retaining me on there payroll i.e. they want me to work for them instead. I am aware that client company has to issue new COS and indian company (my current employer) has to cancel existing COS. but, can you help clarify is there a concept called COS transfer (i doubt there will be one).

Will that mean, i need to await new COS and serve notice period with Indian company (as per their HR Norms) and await working with client company until visa is sorted?

is my understanding apt?

assuming you are currently under T2G, the process:

1. new sponsor assigns CoS
2. you apply for grant of leave
3. you resign but only after your application has been granted by HO

you are allowed to work for your current sponsor until the work start date in the new CoS so in agreeing the start date with the new sponsor take account of the notice period.

Note that if your present leave is T2 ICT you can only switch to T2G if it was granted under the rules before 6 April 2011

Tier 2 - Change of employment/Change of Sponsor - is there a different application form or is the same used for Tier 2 General

One of my friend, who has recently made an application suggests it's the same application.

There is no special form for switching sponsors. But the forms for applying in-country and out-of-country are different. So it may be not the same one you used to get your T2 ICT.
