EEA and Non-EEA couple with baby

Post by richardblackmore » Sun May 25, 2014 9:02 pm

Dear All,

I am an Italian national married to a USA national and she holds a residency permit (EEA family member). Our baby has a USA passport with no visa as he is 7 months old. My wife (USA national) will be traveling with our baby to USA in July and my question is:

Upon return to UK will our baby need a separate visa or my wife's residency permit would suffice. He is my legitimate son but at the moment holds no EU passport due to the long process of obtaining an Italian passport.

Many thanks for any word of advice!!

Richard

as baby holds a an american passport and thats does not need visa its entry so it will be fine ,but try to obtain either RC OR eu passport for child to make things easier.
You may have to fight a battle more than once to win it.
