British citizen and non EU spouse going to Holland.

Post by wannago » Tue May 27, 2014 12:35 pm

Hi all,I`m a British citizen, and my wife is Brazilian,we also have two children who were born here in Brazil.
We had planned at some stage to return to the UK,but with the recent changes about minimum salary requirements that option is not possible for us now.
We have decided to try and use the SS route, this would mean that we would go to Holland, live and work there for a minimum of six months, before trying to go to the UK.
I have read a lot of conflicting information on the internet as to exactly which documents are required for my wife to enter Holland.
Firstly I would be traveling to there alone,so as to secure employment and accommodation, only then would my wife and daughters join me.
What documents would my wife require to join me in Holland?
Any help would be greatly appreciated.

I don't know if Brazilians need a visa to enter the EU. If not: she can just enter as a tourist and then you can arrange to apply for a residence card for her when she arrives.

If she needs a visa: go to the nearest Embassy of the Netherlands and apply for a free of charge, speedily issue NLD visa. My civil partner has had 2 of these from the NLD Embassy in Beijing. Both were issued in about a day (but this doesn't mean that this will happen in other places) and we only provided:
-both our passports (they just took a copy of mine: EEA)
-our civil partnership certificate
-a copy of our flight booking
-a letter from me stating that we would be traveling together (don't think this was needed)
-a completed application form.

Super effective NLD Embassy here in Beijing - really easy.

As we didn't stay in NLD for longer than the holiday, I don't know about the other stuff that you would need to do to get her a residence card. Sorry about that. However, I'm sure there must be a lot of info available via Google in English as I seem to recall that a lot of NLD government info is also released in English.

Hi and thanks for the reply.I don`t think Brazilians need a visa for up to 90 days.Though would there be a problem if she entered as a tourist and then changed here status by applying for a residence card.I also saw on the IND site that there are financial requirements to be met when applying for a residence card.I didn`t think this was the case?

There aren't financial requirements in the UK unless the EEA national is claiming to be self-sufficient (when I guess they would have to show that they actually do have enough money to look after themselves).

Do you have the link for the info you found about the financial requirements in NLD? Post it and someone else might come and give you more detail. Or email them directly to ask the specifics.
