Public funds

Hello

My cousin's partner has recently received further leave to remain and the letter that the UKBA gave to him says that he is not entitled to receive public funds. It also says that his sponsor is not entitled to claim or receive public funds on his behalf. It then goes on to list the public funds that he isn't allowed to claim for and receive which includes child benefit and child tax credit.

My cousin receives these benefits, so I wanted to find out does she need to arrange for them to be stopped? Or is she entitled to them because it isn't on her partner's behalf?

Your cousin should claim the child benefit in her name and the tax credits should be in joint names.

she has done this.

but the concern is that on the letter her partner received it said that her sponsor is not entitled to claim public funds on his behalf, so we werent sure if the fact that she claims these benefits would be a problem.

So are you saying that as the child benefit is in her name and the child tax credit is in joint names there isn't a problem??

my cousin doesn't want her partner to breach his conditions of stay becuase the letter says that this is a criminal offence under section 24 of the Immigration Act 1971.
