ESA entitlement Slovakian resident of 4 years

Are there restrictions to claiming ESA for 32 year old Slovakian national in receipt of DLA high rate care, low rate mobility with severe learning difficulties who has been a UK resident for 4 years?
Has not worked for all of his adult life and needs full time supervision.
Lives with brother and mother, mother UK resident of 4 years is primary carer and receives carers allowance, but no other benefit.
Brother UK resident for 6 years receives no benefit and in full time employment.
All 3 are joint tenants of the privately rented accommodation and receive no housing benefit.
