I need advise on the following query;
Initially my company sponsored my work permit visa valid from 1st august 2007 to 1st august 2010. Even though I initially visited and worked in UK on a few occasions, due to international assignments for most of the time until 14th June 2009, I worked outside UK. Therefore I am not including this period (i.e., period before 14th June 2009) while calculating the continuous residence in UK.
However from 14th June 2009 (3rd date of entry into UK on the same work permit visa) onwards I lived continuously in UK. Also I changed from work permit visa to general visa on 29th April 2010, last year Tier 2 visa was extended and is now valid until 24th April 2016.
I have a PEO appointment for ILR on 10th of June 2014. Can you please clarify the following:
1. Can I use my date of third entry into UK i.e., 14th June 2009 as start of my qualifying period for 5 years continuous residence
2. If the above query is ok, then can I apply for ILR on 10th June 2014 or do I really need to wait for full 5 years i.e., up to 14th June 2014
As my current visa is up to 2016, One immigration advisor has advised me to postpone my ILR application to complete the full 5 years i.e., up to 14th June 2014.
