Discretionary leave to remain Extension- please help!

Post by Tilly44 » Sun Jun 01, 2014 3:06 pm

Help please have been in the UK for 14 years and my situation is as follows;

2000-2009 - was on a dependent visa as I came as a child with my parents
2009- applied as a family for indefinite leave and whole family got it except for me. At that time I was over 18 and was working and studying part time. Visa was declined because, " I was independent, had a boyfriend and a loan" so according to them I was independent and this was at high court. We were declined to appeal. I then applied for asylum which was declined but was granted 3 years DL under article 8, it expired in 2012.
2012- application for extension of DL was made on time and home office have confirmed they have received it but up to this day they still have my documents. Whenever I call, which is on a regularly basis they tell me that they are still looking into it.

My situation has not changed since they gave me the DL 5 years ago in terms of my fears to go back to my country(Zimbabwe). I have been married to a British man for almost 3 years now. Is there anything I can do so I can get a respond from them, I do not understand why it's taking them so long? Please help

If the case continues until 6 years DLR is up, that's around 2015, then you can vary the application to SET(O). As your previous leave continues I don't see this as a necessarily bad thing, although I understand it's difficult not knowing the outcome. If you want a decision perhaps ask your MP to intervene.
