visa on hold...

Hi... my wife originally applied for a spouse visa back in May last year but as we didn't meet the financial requirement our application has been put on hold pending the result of the government's appeal to the court's decision on the financial requirements. Last I heard there will be no news until September, maybe, but no one seems to know anything.

So my wife withdrew her passport, while keeping the application open and on hold, and we now reside in another EU country where my wife has residency as the non EU spouse of an EU citizen.

My question is, is it possible to apply for a family visit or tourist visa to the UK while the spouse visa is on hold? My instinct tells me it's quite unlikely but It would be useful to know...

Hi i am in the same situation as you are. My wife applied in Jan 2014 and as yet we are still waiting for an answer. Did your wife successfully withdraw her passport without having to withdraw the spouse visa application? i heard that if we ask for the passport back, then the spouse visa application gets cancelled, i don't know if there is any truth in this.

Also, if you don't mind me asking, which EU country did you decide to live in? I'm thinking of moving to Ireland to exercise my treaty rights

If she has EU residency can she not apply to visit the UK under EU rules?
