When should I apply for eea3

When should I apply? I want to apply this month, coz I need it as soon as possible for support other application.
June 2009 I graduated in UK
June-Sep 2009, I was looking for job. However, I did not register as unemployment at the jobcentre. I didn’t have any letters and application form as they were done through NHS job website. I had registered to the professional body from July.
5/10/2009 and have a letter confirmed my job offer, but need pre employment check(Criminal records ) when working in nhs, and it stated in the letter too regarding this check,

27/01/2010 Got my Criminal records check done, which I had the copy.
1/02/2010 Letter to confirm my salary and work hours.
1/03/2010 Start working.

I have been here since 2002; I did apply 2 years ago, but got refuse as I didn’t have the CSI as a student.
Can I apply this month under the job seeker or Oct? Or better to wait til March?
