New Rules/Old Rules

Post by Wanderer » Tue Jun 03, 2014 6:37 pm

Someone asked me this and I don't know the answer, so this is me asking!

If some enters on a fiancee visa prior to Jul 2012, does that mean they stay on old rules even if they don't apply for a spouse visa until they actually marry, in this case after Jul 2012, when new rules are in force?

AIUI yes.

But then - anyone who entered on a fiancee visa before July 2012 had this problem resolved a LONG time ago.

Cheers Mate, it's just the person in question doesn't seem to know what visa they have, and it's not someone local to me so I can't see it.

Happy with the answer tho!

A 6 month fiancé visa or a short-term visit for marriage visa? For the former, yes, if they then applied for FLR(M) before the fiancé leave expired it'd be considered under Part 8, just ask them how long their current leave was granted, if 2 years, it's the old rules.

Cheers Amber

It was granted on the face of it for 2.5 years but that was because of a six month delay in UKBA granting the visa after about five months, not because it fell into new rules as I assumed.

Was Fiancee visa not marriage visit visa....

Current leave is 27 months, I was thinking as above but I was wrong, forgot about how UKBA now grant visa from when they got to it, not from end of previous leave, or did I imagine that? Sure our earlier visas all fell in same month despite UKBA/INS or whatever it was back then delays....

Thanks anyway!
