EEA FAMILY PERMIT REFUSED

Post by latviastar » Wed Jun 04, 2014 3:04 pm

Hello ,
I am Nigerian Student and currenthly and have been living with my unmarried partner we have a daughter together which is 3 month old.My Partner is from latvia and a 5th year medical student and she has never been to uk so she decided to take a trip to UK. The problem is that i need a visa to do accompany her.
We applied and finally got the decision today which says its refused. Below is the decision
An unmarried partner can be considered for and EEA permit as an Extended family member if they are in a durable relationship with the EEA national. I have to consider the factors such as length of cohabitation(minimum 2 years)joint finaces, wheather the couple has children to establish if the relationship is durable. You have provided no evidence of shared cohabitation. You have provided eveidence of communication on facebook in 2013 and you claim you have child together but you have not submit translated birth certificate and i am not able to determine if your circumstances are as claimed
I submited communication since 2012 from skype, emails and facebook, birthcertificate ,my finances and a sponsor from uk for finaces,my partner passport and a letter from my partner.

We intend to partner intend to appeal the decision with accompanying translated birthcertifcate and a proof that we live together .

I will really appreciate advice on what to do in this situation.

Loooking forward to various input

Stating that you have a child together but not proving that by providing a birth certificate clearly stating both names was a bit of a mistake.

You can apply again at any time, but you should make sure you address their refusal reasons, i.e. if you have lived together before, provide evidence of this (rental agreements/utility bills etc) and also make sure you provide evidence of your baby (birth cert is the best one).

Where are you living now? Applying in Nigeria or in Latvia? What is the purpose of your visit? Holiday/work?

Hiya, according to your refusal letter, you need to show them evidences that you have lived together for 2 years like tenancy agreement with your names together, joint bank account, photos together (better if you have old photos together since the day you started your relationship), facebook, skype or txt messages between the 2 of you and any other evidences that you think will prove that your relationship is genuine. About the birth certificate of your child, i think you need to submit an english birth certificate.

Im not expert so you need to wait for some other very good people here who knows a lot of things. All you need to do is prove that you are in a durable relationship as you are applying for unmarried partner.

Goodluck.

Provide them with a translated copy of the Birth cert, provide any evidence to prove that your relationsship is well established, joint bank account if you have one, ultimately they ECO should favourably consider the application if you provide the translated copies of the birth cert. some family pictures will also do some help.
