Deportation

Post by Harinder dhami » Thu Jun 05, 2014 12:10 pm

At the moment my boyfriend is on a spouse visa and is currently going through a divorce. Once his divorce goes through can he get deported and will he be able to appeal to stay in the uk?

Deportation is for undesirables and criminals. You are referring to removal. If he can't extend his current leave or apply for ILR (which clearly he can't if the relationship has broken down) he will have to leave the UK and re-apply to enter in another category. If he does not leave the UK, when his visa expires he will be an overstayer and that is when removal measures may be considered depending on how long he actually remains and the rate of detection by the UK Border Force.
