ILR or FLR

Hi all

Just a few questions if anyone can help. Apologies if these subjects have already been covered.

My husbands spouse visa ends in August. We hope to apply for ILR but that depends in if he can pass LIUK after 2 failed attempts already.

If we have to apply for FLR do we have to wait until them 2 years are up before applying for ILR. If he passes LIUK in within that time do we have to wait. Also does it cancel out the original visa, as in can we still apply under the rules before 2012? As the initial visa was before then does it apply for FLR for financial requirements? We have a combined income of around 24000.

We are still living with my parents in their rented accommodation do you need to submit the same information as the initial visa such as letter from the landord and floor plans?

I don't claim working tax credits but I know that I could, if I did would it affect out visa?

Im quite wary of our visa application this time as I feel we are considered insignificant citizens in the eyes of the goverment, hoping for a miracle and they scrap LIUK eventually or at least make it relevant

Also as we have been living with my parents we dont have anything with both our names so would things like bank statement letters from Dvla etc be accepted and do we need a letter from my parents again to say it suits us all to continue to live with them?

If you can't apply for SET(M) you can apply for FLR(M) and you can subsequently apply for SET(M) at any time so far as you meet the requirements. For cohabitation proof, the letters do not have to be in joint names, a letter each for every 4 months from a total of at least 3 different sources will suffice. You may claim tax credits as a couple.

Bear in mind that if your husband applies for FLR(M), he will need to pass the A1 English test. For ILR he will need the Life in the UK test certificate and to pass a B1 level English test.

He is booked for a Trinity test in a few weeks. Just speaking and listening though is that ok for both visas?

Do you need letter from employers or is P60s and wage slipa enough? And does anykne know about letters from the landlord and parents which were included in the initial visas?

Can anyone advice on my most recent most?

Also my husband will have been in England for two years on the 7th of June his visa ends on 7th August. Can we apply 28 days before the 7th of June or is it after then and 28 days before the visa ends?

We will be applying for FLR as unable to pass LIUK after 4 attempts. Can we apply in person on the 2 year route? On the gov website I recall reading that you can apply in person for the 5 year route.

Also and lastly for now my husband works as a casual worker so no contracted hours although wage slips show on average full time work over 2 years.....he doesn't have a contact but I'm sure we can get one but it would be as casual hours. Does that matter...bearing in mind my incomeIis enough for maintainance on the pre July 2012 rules.

What would be sufficient for accomadation?

We are still living in my parents rented property which they have lived for over 5 years. For the initial visa we submitted letter form my parents, the landlord and I paid someone to do a plan of the house (its a large house so there is room enough for us all)? Do I need to supply the contract and landlord letter again and the plan or would a letter from my parents confirming that we still live there and can continue to live there as we wish.

In the initial spouse visa we said we will live ther rent free which we do really we just contribute £300 a month towards household bills and housekeeping for my Mum (she still does our washing and ironing). So would an explantion from my parents cover that. (our joints income is more then adequate to rent our own place which they would see through our payslips/bank statements)

As we are on the rules for pre July 2012 for maintenance costs would things like catalogue payments be deemed as disposable income?

And all my payslips and bank statments are in my married name but my passport is in my maiden name still as it does not expire until next year and I just havent got around to changing it. Does that matter??? What name would I put for myself on his application?

Sorry me again.

In the flr application form when did you meet your spouae and when did you get together...quite frankly I cant remember what I put...we met jan/feb 2010 and relation developed theres was no relationship commencement date but I think I put feb/mar or even April. We met got together and living together by may time. Will they cross check the initial application or does a month either side make much difference? Any suggestions?

I suspect you'll be ok. You should keep copies of any applications you make and proof of postage.

Hi me again

Few questions.

1. For maintenance am I right in thinking that £113.70 is the income support for a married couple and thata what we need to prive we have left over every week.

2. We pay £300 per month direct from my husbands to my dads bank....are the bank statements enough to show this with a letter from my dad? Should I declate that as rent on the application?

3. Do I have to have a letter from my employers? Is a recently signed contract with start date, work address etx enough? Don't really want to approach my employer becauae their not the nicest of people.

4. For sponsors name do I put the name on my passport or married name which I use for work bank tax etc and put my passport name in the known by other names part.

Sorry about all the questions again, have been to immigration advisors in my area but they only seem to know about asylum...one even told me that we had to meet the financial requirements (as we got initial entry clearance in april 2012 om sure that's incorrect).

Do we have to include letters from myself and my husband about out life here.

My dad has written a letter confirming we live in their rented accommodation (have plenty of documents for both of us with address on)...no tenancy agreement as after 7 years we basically don't need one and its the same house as his initial spouse visa. (Do have an inspection report although its 2 years old as again from initial visa)

I have been told I'm worrying for nothing but I don't think you can ever be to sure with UKBA

What about the name? I was going to my married name first as it is the name I go by and maiden name in any other namea at its on my passport.

For the biometrics he had finger prints taken for initial visa but never got a permit he had visa put in his passport so whenit asks have you and when did you have biometrics taken before I assume it is yes they have been taken?

Visa approved within 2 hours at Sheffield PEO. Really nice staff.
Said we would of got ILR no problem if he had passed LIUK.
