Tier 2 ICT Long Term - Salary components

Hi,
The Tier 2 ICT long term visa eligibility says that atleast 41000 GBP salary must be paid. But in this salary can there be a fixed and variable pay components? Such as 90% of 41000 (which is 36900 GBP) fixed and the rest 10% dependent on performance and hence variable? The 10% dependent variable would mean that any amount within that 10% can be paid.

I was under the impression that the company has to pay atleast 41000 GBP fixed (before tax) to the employee for Tier 2 ICT Long Term.

In my opinion, The fixed salary needs to be mentioned on the CoS and only the fixed component of the salary will be counted towards the points.

Any performance related bonuses which are over & above fixed salary, are not counted towards the overall salary and towards points. Please note that sometimes organizations provide accommodation allowance, which can be part of fixed salary (there are, however, T&C's that such allowance should not exceed more than 40% of fixed salary)

FYI I speak from experience, my current salary is XXX fixed component and 10% performance based bonus on top and on the CoS and SMS, the employer declared the salary as XXX (fixed component) only.

Thank you very much for the reply. My cos states the gross salary only. However, the employer's letter to the consulate says that contracted and fixed performance allowance has been included in the gross as per UKBA policy, and the gross salary has been converted on the day of sponsorship using OANDA. Hence the worry and confusion. Moreover, I am under the impression (as per wordings in T2 policy guidance) that a fixed minimum 41k GBP needs to be given. Hence, if there is a variable component then it must be apart from this threshold. Is this understanding correct? Thanks once again.

There was no need for your sponsor to write any letter to the consulate and unless you quote it verbatim it is not possible to say whether it will cause any problems. The rules are quite clear, refer to the T2 policy guidance paras 44 and onwards:
