CAN I APPLY FOR ILR

Hi every one
i came here in the uk on a work permit in march 2003, i worked for my employer for 4 years. in jan i got married with a European and got i year family permit. my question is that, am i still eligible to apply for ILR in march 2008 or i have to wait another 5 years as a EEa dependent .

Just an informed guess from me till the experts come along but I'd imagine that as you've switched routes you are firmly stuck with a five year wait.

Yes although the family permit superceded the wp, as long as his stay i legal in the UK for 5 years, i do believe is still entitled to an ILR.
Guess Victoria will have to chime in to confirm.

Before applying for the Residence Card did you take any advice, or even look at any board like this? My reason for asking is that if you had done so you would have found out that switching from WP to the EEA/EU route resets the 5-year clock.

And technically you will never be entitled to apply for ILR, but in January 2012 you will be able to apply for Permanent Residence, the EEA/EU equivalent of ILR.

However - how long has the OP's wife been in the UK? He might be able to go the spouse visa route?

my wife she came and started work here in december last year...and my work permit is not canceled but the nursing home is closed so cannot go back to work there...just wanna ask that if there is no hope for ILR than i should 't apply for one in march next year..just dont wanna pay the fee if there is no out come...or shal i give it a try ....plz advice

When did the nursing home close?

Also when you apply for ILR via the WP route you will have to provide a letter from your current employer detailing your employment continuing with them and how do you plan to do that?

What do you mean your work permit is not cancelled?
When you applied and obtrained a permit to stay on a different basis, I believe it overrided the work permit. So maybe you didn't cancel it but it is effectively cancelled, at least that is how I have been led to believe how it works.

AHH, well OP run with your work visa, run do not get the dependant visa, you are too close now but BAD BAD situation with the employer being non existent

He has already said he got a family permit in January, which is valid for a year, so he is clearly not illegal.

He also is going to have to wait to apply for ILR/PR until January 2012.

No need to scare him into thinking he's done anything illegal.
