Is my visa still valid?

Post by crhynes » Thu Jun 19, 2014 11:55 pm

I currently have a further leave to remain visa that expires 1st Dec 2016. Due to some family commitments I have been living in NZ since November 2012 but am returning to the UK at the end of this year. Can I re-enter on my visa? Or will it be invalid seeing as I was out of the UK for just over 2 years by the time I return.

If it is will be invalid what is my best option for a new visa? My husband and children are all british citizens and I'm also eligible for an ancestral visa. So I could either get a spouse visa, ancestral or is there a parent one of some sort?

Thanks in advance!

:)

Even ILR becomes invalid after 2 years absence from the UK. If you apply for a spouse visa you will have to meet the financial conditions at each stage of the 5 year route to permanent residency. Under what category was your current visa issued?

What kind of leave do you have?

My current FLR visa was an extension on my original ancestral visa.

It should remain valid. When you return you may be eligible to extend, assuming you get a job. Ancestry leave would be more advantageous than spouse leave based on the Financial Requirement.
