Hi

Sorry for lengthy post.
I worked in UK in T2 ICT visa til may 2014 and wife had a dependant visa, Originally our visa extension was about to end on 27th Jan 2014, My wife and baby wanted to travel to India and so we did not plan to extend her visa, only my visa applied for extension and got extended till May 19 2014, but unfortunately my wife could not travel on 27 Jan 2014 but travelled out of UK on 29 Jan 2014(1.5 days overstay) as our baby's passport got delayed in HCI London. i also travelled out of UK on May 2 2014 (visa expiring May 19 2014) as my assignment got over.

Now My wife's employer is ready to sponsor her a T2 general visa, we are ready with the COS to apply outside UK. the issue here is, just worried if her 2 days overstay will affect our visa this time as my wife is main applicant now. we are filling the application form that she travelled out of UK on 29 Jan 2014, but not sure if we need to mention 2 day over stay and the reason behind it. Kindly advice the best way to proceed here. we have enough proof to show that 2 days overstay was unexpected from our side.

Personally, I feel its better to tell about the 2 day delay and mention the actual reason for it. If the reason is genuine, HO may consider it. Hiding facts initially and HO finding about it later may lead to unwanted issues (worst case, you can be banned from UK for hiding facts). Even the application form mentions the fact that its better to provide reasons rather than hiding fact.

But, that what I feel personally. It'll be your call in the end to decide the way forward.

your wife should declare her 2 day overstay in her application. It will not be a reason for refusing her application for entry clearance but concealing it would.

On the VAF 9 paper form the question is at 6.6:
Have you ever been in breach of your immigration
conditions for the UK
? - if she is applying online there is probably a similar question.
