Visa Extension 5 year cap rule help

Dear Friends,

I needed some understanding of the 5 year study cap rule and how it will affect me. I am listing below the details of my history.

01.08.2009 - Student Visa (ACCA)
31.10.2011 - Student Visa Expires
20.10.2011 - Applied for PSW Extension (Rejected) This case went into appeal for 1.5 years untill Feb 2013 when I withdrew the appeal to apply for a new Tier 4 Student Visa.

01.02.2013 - Tier 4 Student Visa (Masters)
31.10.2014 - Expiry

My questions are:
1. Will the 5 year cap affect me if I have to resit my final semester.
2. if I do have to get a 6 month extension on my current visa will they count it as 5 years on Student visa as almost 1.5 years I was on appeal.
3. Because my current visa extends to Oct 2014 i.e. more than 5 years is it ok to understand I am not yet under 5 year cap.

you still not over the 5 year cap. If your Uni allow to resit and issue you the CAS for the resit (which most of the Uni do not do now a days unless you have to attend full time classes before the resit), then I do not find any issues to apply for the visa
