Tier2 - ILR next year - Having Baby in July

Hi All,

I have a rather peculiar query that I could not find already discussed. If it is then please direct me to it.

Me and wife have been in UK 4 years, and get eligible for IRL next year. We are having a baby this month.

Our plan was to apply for Baby Passport only once we get our ILR, however, we need to travel in December for 2 week this year and hence Baby will need to leave and re-enter UK.

One option is to apply for a Baby Dependant Visa which is roughly £1000+.

My question is :
Can we apply a tourist visa costing £90 or so for the baby to re-enter UK after our vacation ?

Then once we receive our ILR, then we can apply for Baby's British Passport.

A child resident in the UK can't be a UK tourist.

Even though its only for 3 months ? As we return in Dec 2014 and apply for ILR in March 2015. So could apply for Baby's passport in March/April 2015.

The child would have to be registered as British before being entitled to a British passport.

If you intend to leave the UK with your new born child and expect to return with them they will be have to have a dependent visa.
As for a UK passport your child will only be able to naturalize when you do.
ILR does not give you a UK passport.

Thanks for your replies. However, still not completely in agreement. Though I am sure you guys have some experience than me, certainly :)

In principle, as long as the child is only in the UK for 2 months, before directly applying for ILR as a dependant on us, why (in principle), can the child not be on a Tourist Visa.

As a tourist visa is up to 6 months for any one, right ? May be I am missing the point but appreciate some clarity.

Is there anything on UKBA policy that restricts this ?

A general visit visa/family visit visa is for those who don't intend to settle in the UK.

Could you also point me to a link/extract on UKBA rules/policies which states the above or restricts Tourist visa for those intending to settle later ?

Thanks for sharing. Nothing there suggests to me, that child can not apply for this visa.

The line thats contentious is "be visiting the UK for no more than 6 months". Which in our case would be 2 months.

Once we get ILR, we can always apply for British Passport for the child ? Is that correct ?

A UK born child is entitled to register (to become a British citizen) immediately after a parent is granted ILR.
