Spousal Divorce...Please help!!!

Hi master,my name is Jerry,i have a 30 months Spousal visa,which i have only just used 17 month out of my first 30 moth visa...i married her because i truely loved her,not a shame marriage,but we have been together for 3yrs i am not happy at all.......she's certainly not what i'm looking for....my question is shall i wait till i get my ILR before i can file for divorce...She's willing and ready to leave me too..Please help all advice are welcome..tanxs

If you separate before you have ILR your spouse visa will be invalid. You therefore wouldn't be able to apply for ILR. Are you still living together?

Not just that when you come to renewing your spouse leave, you won't be able to if the marriage isn't subsisting, do you have children?

thanks for the reply casa,yes we still live together and she's seeing someone according to my intel,she doesn't even talk to me anymore...She's British by the way.....so how will i cope when she's want a divorce now..please i am in deep agony and sadness..i need advise..i've never been this confused in my life

We don't have no child,we have both tried for almost 2yrs and i think this is why she want to leave too...not sure though,but things aren't just working out...
