Change of Employment - Salary Requirements

Hi All,

I really need some advice with my situation; I am on work permit with an IT company which is valid till 2010. The company I am working lost some good clients, so there are chances to shut the company or reduce staff.

I have already started to find another job, One of our ex client company offer me a job, but they cannot pay me the same amount of salary which I am getting from my current employer.

I don't mind about the salary, the most important thing is to secure my wp. If I will accept the new job from the new company and they will apply for my wp, will it be a problem for me or for them as my salary is going to be less than the previous one?

Could someone please help me about this? I really need some advice before joining them.

Current Salary Package: 30K GBP
New Salary Package: 22K GBP

The salary being lower in the second company by itself should not be a problem. It will be proving that the other criterias have also been met that will determine if they can successfully obtain a work permit.

I could not understand about "other criterias", did you mean job type? I am going to have the same job type with the new company, currently I am working as a "Application Developer" and I have to perform nearly same duties with the new company.

The new company got some franchise businesses and they wanted me to work with there IT guys. Company is legitimate and in trade since 2004.

The main part of the "other criteria" is proving no UK/EEA national is available to do the job that you are currently doing and why you are better than any other EU national who also applied for the post. Have a look at this document for further understanding.

According to Section 128:

You do not need to provide evidence of a recruitment search if we receive your application either before they leave their current employment or
within 28 days of the persons last day of work with their previous employer, and providing they will be doing the same type of job.

So why does he needs to prove that "no UK/EEA national is available to do the job"?

I am just changing my employer, my job title and duties are same with the new employer.
