Appeal withdrawn but refund refused

Hi,
I submitted my appeal when I was refused a RC. A few weeks after that I re-applied under different circumstances and now have my RC.
On receiving my RC I withdrew my appeal and requested a refund. I have received a letter confirming that my appeal has been withdrawn. I then requested my refund but have been told that I will not be refunded as my request does not meet the refund criteria in Article 9 of the order.
Has anyone else had any success in getting a refund for the fees paid and if so please let me know how.
