ILR Eligibility - missing employment reference/leave letters

Post by varunchadha2583 » Sun Jul 06, 2014 8:10 pm

Hi All,

I have a query regarding ILR Eligibility. Below is the details of Visa granted:-

Visa Details:-

Date Visa Granted---- Visa Category-------------------------------End Date
20/01/2010----------- TIER 2 INT COM TRAN(MIGRANT)--------10/02/2011
11/02/2011----------- T2 ICT EST STAFF LEAVE TO REMAIN----17/05/2011
27/06/2011----------- T2 ICT LONG TERM LEAVE TO REMAIN ---16/05/2012
04/07/2012----------- T2 ICT LONG TERM LEAVE TO REMAIN ---29/05/2013
17/01/2013-----------Tier 2 Gen. Leave to Remain--------------01/02/2016

I have been in and out of UK as per following:-

Entry in UK------Exit from UK-----Reason to Enter-------------------- Reason to exit
24/01/2010----- 14/03/2010----- Onsite Assignment-----------------End of assignment
20/06/2010----- 13/01/2012----- Onsite Assignment-----------------Went for Marriage
18/02/2012----- 27/04/2013-----Back for Onsite Assignment-------- Annual Leave
26/05/2013----- till date---------- Back from Annual leave-------------Not Applicable[/b]

I have following queries:-

1) For my first exit i.e. from 15/03/2010 till 19/06/2010 – I do not have any activities in UK so does it count for my ILR duration as a continuous period in UK? I was back for same employer and same client. Does this duration count against my ILR.
2) If above duration does not count or to be safe I do not include above duration, would it be ok to apply for ILR in July 2015 against my arrival in June 2010?
3) For my second exit i.e. from 14/01/2012 till 17/02/2012 – I was back in India for Marriage but have salary slips to support I was still paid in UK so was on Annual Leave. I have left the organization I was working for that time when I got my Tier 2 General so getting a letter from them would be difficult so need to understand if Salary Slips would suffice?

Thanks in anticipation,
Varun

So far as absences are less than 180 days per 12 month period you should be ok.

Thanks Amber.

I am still unclear about what supporting documents are required for period I have been out of UK specially coz I am on Tier 2 Visa, particular to the point 1 :-

1) For my first exit i.e. from 15/03/2010 till 19/06/2010 – I do not have any activities in UK so does it count for my ILR duration as a continuous period in UK? I was back for same employer and same client. Does this duration count against my ILR.

Thanks & Regards,
Varun

There shouldn't be any needed despite what the guidance states.
