Passport lost

Post by cooobra » Fri Jul 11, 2014 8:32 pm

Heya,

I have lost my passport and I really need to go home ASAP. If i get a new passport/travel document, will i have to contact the home office and transfer my visa on it? or can I just take the new one to the airport and leave?

Thank you in advance.

How are you going to re-enter the UK without a visa?

Overstayer - Passport check?

Post by cooobra » Fri Jul 11, 2014 10:49 pm

Heya,

I -very unfortunately- overstayed my visa with 4 months :( and I wish to go home now (Egypt), I have heard that UK does not give out an exit stamp. Does anyone know if that's true? Is there any chance that I go through without anyone checking the date of the visa expiry?:(

I am very nervous as I came on a business type C visa and had come many times and never overstayed or broke any law. But this time, due to unfortunate events I -had to- overstay. And I've got a very good offer of a company to sponsor me in on a tier 2 general visa. I've got the CoS number and all is good. I talked to a lawyer and he advised to "take my chances" and leave and a big chance I will go through undetected and apply for a visa from home. Another lawyer advised to mail Home office claiming that I had sent my passport and FLR (o) forum but it's been lost in mail and guarantees that this will get me some sort of declaration and a reason why I overstayed.

I do not like breaking the law. The idea of going on with the FLR (o) "scam", I honestly don't like. In my entire life, this is the first time I break the law -any law- and I do not want to carry on doing it.

Problem is, if i don't go home ASAP I will lose that offer from that company. And I know that this position, I will not be able to get it again in 10 years. Please guys, any advice will be rather appreciated :(

Ok ... let's start at the top.

The UK doesn't have exit controls.

However, the Stupid do share data collected from their swipes of your passport (known as API) as you board a plane with the government - so there'll be a record of your passport on a plane. Also - wouldn't the Egyptian authorities stamp your passport on arrival? (Or do they not do that for Egyptian nationals?)

Since you've overstayed by more than 90 days - you are now subject to a 1 year automatic ban. I don't think you should plan on that job.

Any attempt at deception - e.g. pretending you didn't overstay - could make that a 10 year ban if you're found out. That ban could be enacted at any point if it was discovered later.

I do not understand how the lawyer advising that you 'lost' your passport recommends you explain how you 'found' it again to make a second application - or even to travel home!

Remarkable.

In one thread you've overstayed by 4 months and in another your visa is just about to expire.

Care to explain?

Heya,

Thank you for replying.

First of all, yes the Egyptian airports stamp you in. But the only benefit i ever found out about being an Egyptian is that I can get a new passport within an hour if i were in Egypt. So, I would get just get a new passport.

As for that bloody lawyer, his plan was to shred my current passport and apply for a new one/travel document from my embassy in the UK.

So look at it from UKBA's point of view ...

Let's assume you a) shred the current passport, b) get a new one here. UKBA - they see the entry stamp - thought process 'why did it take 4-5 months to get a new passport in London?' - contact Egyptian authorities and ask ... oh wait - it didn't ... deception ... 10 year ban.

Or - let's assume you a) shred the current passport, b) get a new one and return, c) shred that, d) get a new one. UKBA thought process 'hold on - he must have entered the country on some passport ... where is it? Is it declared in the application? No ... hmm ... deception ... 10 year ban'.

Or - if you declare it ... they'll want to see it.

Accept the job is gone. Take the one year ban and re-approach the company after that.
