WAITING FOR MY DECISION FOR 5 YEARS, CAN I APPLY FOR ILR

Post by MALIKG » Tue Aug 07, 2007 10:42 pm

hi jus want to ask few question regarding my immigration status, if any can give me good advise, well!.......... i came here in dec 98 as a visitor on a genuine visa issued my british high commision in back home and applied for asylum, my solicitor was very lazy with no knowledge as i was new and didnt have any clue how to approach to a good solicitor, i got a letter from home office that i can live and work here until my case is under consideration, i been working in security and for tesco store, in 2002 i went to see my solicitor and ask him about my case and he told me that ur case has been refused when i asked him show me any , he didnt show me nothing and gave me my passport back, then i went to another solicitor and he applied on the basis of humantarian protection and in April - 2003 i recieved a letter from home office that my application has been accepted as valid and i can work here and live here until the case is under consideration, and its been almost 5 years and my case is still under consideration,

so this is my story, can u please tell me if i am eligible for permanent residence like ILR or humantarian protection under the 5 years rule

waiting for ur kind response.
Thanks

I'm sorry my friend, there is no five-year ILR rule for people here claiming asylum. If only! As things stand, you MIGHT qualify after 14 years.

Whether it is worth pushing for a resolution of your case depends on a realistic assessment of the likely outcome. As you fortunately have permission to work, you can just continue to live your life and hope for the best. The Home Office are planning to review all old cases by 2012 and resolve all cases by either removal all grant of status. No-one, probably including the Home Office, knows how this will work out in practice, but it may very likely lead to papers for those who are difficult to be returned as long as they have not got a criminal record.

What country are you from? Nationals of eg Somalia, Eritrea, Palestine, have good chances of remaining.
The Refused are coming day-by-day nearer to freedom.
