Need help ASAP! Tier 2 Visa and Fiancee

Post by ras9zg » Sun Jul 13, 2014 11:54 pm

I recently landed a job with a top UK employer and received my CoS a few days ago. Right before I got my CoS, my longterm boyfriend decided to propose. This is excellent news... except for the fact that he is a British citizen. The online visa application asks for 'marital status' in which I now have to put that I have a British fiancee. Is this going to cause any problems with the Tier 2 application, when in fact I was moving specifically to the UK for this job? Do I need to make a note of this on my application or will that draw undue attention? Thanks for any advice. Very worried that we may have ****ed up.

your marital status is single and your engagement is not relevant to your T2 entry clearance application, no need to mention it.

Once you are in the UK and decide to marry there are various options for settlement such as applying for ILR once you completed 5 years on T2G or a spouse visa which also takes 5 years to settlement:

I appreciate the help; however, the online form specifically has a category as fiancee. I'm a bit worried about that. However, I completely agree that my marital status shouldn't be relevant to my T2 application.

did you come across anything in the online tier 2 visa application that refers to fiancées?

The choices under marital status on the paper application form VAF9 are:

Single
Married /Civil Partner
Unmarried partner
Divorced / Dissolved Partnership
Widowed /civil partner
Separated

You are confusing a Tier 2 visa with a visa to come to the UK for the purpose of marriage - the two are completely different visa categories

The new choices on the online system are as follows (I just checked my application to be sure):

Single
Married /Civil Partner
Unmarried partner
Fiancee / Proposed Civil Partner
Divorced / Dissolved Partnership
Widowed /civil partner
Separated

The paper form doesn't have these categories listed as such - so now I am entirely confused about why they added it to the online form and not the paper guidance forms.

interesting because the VAF9 paper form from which I quoted the 6 categories of marital status is the current April 2014 form.
(btw- the penultimate category should have read "Widowed /surviving civil partner")

Please describe the sequence of steps in the online application before you got to the marital status question

Sure - happy to describe.

The top of the online form states that I am applying for "Work - Tier 2 (General) visa - General Migrant, up to 3 years"

The sidebars that walk you through the application are in order:
Passport and Travel Information
Personal Details and Travel History
Family Details (this is where the fiancee question is asked)
(the first question under family details is marital status - which is where the drop down list comes in). After answering fiancee - it asks for their passport / nationality / name / DOB / if they currently live with me / address)
Medical Treatment
Tier 2 Skilled Worker
Additional Information

"Single" and "fiancée" are not mutually exclusive terms. One can be single and a fiancé at the same time. Presumably your passport shows your marital status as single. Fiancé in an immigration context is relevant if a person wants to enter the UK for the purpose of getting married which is not your case, you want to enter for a different purpose, work.

I'm not sure what the reason for "fiancée" appearing in the marital status drop-down list for T2G online applications is and note that it is not on the current VAF9 form.

IMHO you can state your marital status as single.

UKVI have a facility for asking questions but don't hold your breath to get a meaningful answer:

Just wanted to update the board in case anyone is worried in a similar case such as mine.

Spoke with the consulate today and they advised that there would be no problem claiming my British fiancee on the Tier 2 form and that this wouldn't delay my visa decision. So very good news.
