Qualifying Period for PR- which 5 years?

Post by Viktoria27 » Sun Jul 20, 2014 11:59 am

Hi,

Basically, I came to the UK in May 2006 and in September 2006 I started working, then I became pregnant in March 2009 and in September 2009 cased employment. Then I've been self sufficient and student until now.
I have applied for PR in May 2014 and have been refused for receiving Working tax credit ( actually it was my non EEA husband who was in receipt of the benefit) and lack of transactions on bank statements.

My question is can I re apply and only prove the 5 years exercising treaty rights from 09.2006 to 09.2011 as during that time we weren't in receipt of Working tax credit. And from 2011 till now just the proof that I have not been out of the country for longer than 6 months? If yes, then what shall I write in cover letter?

Also as proof of self sufficiency can I only send first pages of banks statements where it says how much have been paid in and out of the account rather than the whole bank statements ?Also my husbands tax returns from self employment plus non UK EHIC ?

Thanks in advance for any answers.

Your application refused in May 2014 as you explained on the bases of benefits, and un satisfactory bank statements.
I think it's better to re start your five year clock for PR again, but nothing wrong if you re apply pr with the support of your treaty rights from 2006 to 2011.
You are require to sent full bank statements not only front pages.

Yes, you may certainly apply for PR based on exercsing Treaty rights between Sep 2006 to Sep 2011 depending on whether you took out Comprehensive Sickness Insurance for you and your family during the time that you were a student/self-sufficient? If not, then I'm afraid you do not qualify for PR.

I'm of the mind that if you don't receive any benefits, this means you are self-sufficient - I don't know why the Home Office have to insist you have to show funds in your bank account, but these are the rules unfortunately.
