Visa initiation before Cooling Off

Hi,

Please help me on my below query.

1) I was in UK for the period of 12-DEC-2012 to 27-OCT-2013 under short term (Tier 2 ICT).
2)Now I had to travel to UK by Nov 1st week 2014. Can I apply for short term tier 2 ICT in the month of AUG 2014 with the visa start date as Nov 2014 ?
3) is this an acceptable case ? I am confused with cooling off period.

Sorry to say SRI but you cant give an application before 27th October 2013. Visa rules says that candidate should not have tier 2 in last 12 months from the date of application. In case applicant had tier 2 and was not in the UK for last 12 months then also he can apply, but candidate need to show that he was not in the UK from last 12 months which can be shown from stamps on passport.
