EEA3 eligibility

Hi guys,

These questions may have been asked in some other form previously, so apologies for repeating but I've not been able to clarify it properly.

My partner is an EEA national looking to submit an EEA3 application.

1. Portuguese citizen
2. Student from 2004 to end of 2012
3. Had two absences in 2013, one of which is more than 6 months.
4. No comprehensive sickness insurance between 2004 and 2012.

The questions are:

1. Does the lack of comprehensive sickness insurance between 2004 and 2012 means that these 5 years are not valid for the EEA3 application?
2. If, hypothetically, her previous 5-year residence is valid, can she apply on the basis that she was eligible for permanent residence in 2012, even though she now has a longer than 6 months absence in 2013?

Thanks very much for all help, let me know if there is any more info that can be helpful.

Note: I am a non-EEA national myself.

2. Yes she can 5 years continues

• She has worked full-time for 5 months, but the other 4 years and 7 months have been as a full-time student, without part-time work.
• She did not have an EEA1 registration, unfortunately.

Thanks again for info. It just sometimes isn't clear that the insurance needed to have covered the full 5 years, instead of maybe just a portion, or have insurance at the time of application.
