Tier 2 and part time work

Hi,

Can anyone please advise me on this please? I got two T2 extensions so far, one was from June 2012 to December 2012 and other is for two years Jan 2013 to Jan 2015. I have been workings full time so far. If i choose to do part time work and criteria of minimum salary £20500 is fulfilled for another 3 years on T2 visa. Will I be considered for ILR after my stay for 5 years in the UK is over ? I am working as a Research fellow in the University and I have done my PhD from UK University.

It is with same employer and as a research fellow but not full time.

The only info I could find in the guidance said that if you are a shortage occupation worker, you cannot be sponsored for less than 30 hours per week. I did not find anything (either way) about Tier 2 general non-shortage...

Perhaps someone else will enlighten us?

Same level of work, doing the same type of role and at the same rate of pay (meets the minimum rate of pay for the role)- assuming these are all met and you are doing not more than 20 hours additional work then you will be ok to undertake the work. Extract from guidance:

Supplementary employment
In addition to the job specified on the certificate of sponsorship (CoS), the applicant can do extra work if it is: 
in either a job on the shortage occupation list
or a job in the same sector and at the same professional level as the work for which the CoS was assigned 
no more than 20 hours a week,
and outside the working hours covered by the CoS.

If they meet the above requirements the applicant does not need to inform the Home Office.

Your second point - I don't think I have grasped where you are going with the ILR and salary route.
Are you saying you do not earn £20,500 in your current role and need the p/t work to bridge the gap?
Or are you looking at the £35000 pa salary to access ILR post April 2016?

No , It is nothing to do with doing extra work. It is switching from full time to part time work with same employer. I have done full time work on T2 visa for more than 2 years so far. At the moment my annual salary is £28 k. I just want to know, when time will come to apply for ILR after my 5 years are over on T2 visa ( in June 2017 ) , then doing part time work for rest of the 3 years will make me eligible to qualify for ILR or not?

Are you suggesting that for the remaining period up to the time you apply for ILR that you will work part time? Sorry slow on the uptake with that.

As long as you meet the minimum requirements of the SOC you can work part time.

When the time comes to apply for ILR that will be a different matter. You will be required to demonstrate a yearly salary of £35000 if along the way you receive a massive pay rise great, if not then ILR will not be an option.

Hi ,

Can anyone help on this please?

I have a Tier 2 (General) visa which is going to expire soon ( Jan 2015) .It has been more than 2 years since iIstarted full time work on Tier 2 G visa. My sponsors are happy to give me extension for another three years but not as a full time worker, rather on a part time basis which means reduced number of working hours and reduced salary . My queries are:

1 Is it possible to extend the Tier 2 visa like this?

2 Will I be able to qualify for ILR in June 2016 on this basis ( 2 years of full time and 3 years on part time )?

3 Date written on first BRP issued for T2 is considered for counting 5 years for ILR application or it is the date when i applied Tier 2 first time? For eg. I switched from T4 to T2 in month of April 2012 but I was issued BRP in month of June ( 18 June 2012) . Which date will be considered to count my period on T2 visa?
