**To apply or not to apply - Husband's Visa**

Post by Fozia_Akhtar » Wed Aug 08, 2007 10:10 pm

First of all, apologies for the long post. Ive had a search on here to see if anyone else is or has been in a similar position to me and I couldnt find any anwsers hence the post.

Im in a bit of a dilemma.

I got married in Dhaka, Bangladesh at the start of the year. Im now back in the UK - 6 months pregnant.

Ive done quite a bit of research on applying for a settlement visa and Im aware that my husband and I need to satisfy three main points:

- Accommodation
- Relationship
- Employment

Im confident that I can satisfy the accommodation issue as Ive just moved into a 4 bed house with my sister who has confirmed that she will be responsible for paying the mortgage and all food and utility bills (until my husband gets EC).

Im also confident that I can satsfy the genuine relationship issue. My husband and I communicate everyday by telephone, text messages, MSM. We also regularly send each other letters, photos etc I have kept copies of all of this as well as stuff from our marriage - honeymoon pics, wedding receipts, and ofcourse I have scans of our baby so I can confidently say we satisfy the relationship issue.

My main concern is the employment/financial issue. Im employed as a supply teacher. I will be returning to work in September but I have only been with the agency from this summer. Im concerned that physically I will be unable to work full time as I will be heavily pregnant. Supply work does provide good day to day wages but i have no guarantee that I will get work everyday or if I will be able to do work. I am aware that I need to show at least 3 months paylslips and bank account statements.

My family and sister have been very supportive in that my sister has confirmed that she will be responsible for the mortgage, utility bills and food expenses (she earns in excess of £35k and is single with few expenses) and my parents are able to support me financilly by providing me with £1,000.00 a month until my husband gets EC. (This will be from September)

In addition to this, I have sufficient savings and my husband has already secured a full time job here and we have confirmation of this.

My question is, should we apply for EC now and if so what is the likelyhood of us getting a positive outcome?

Any advice would be greatly appreciated.

Many thanks.

Hi there

I have approximately £8,000 in savings and my husband would earn approximately £18,000 per annum.

That looks fine - you would be well above benefits level, which is the level generally used.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.

Thanks for your advice Victoria.

Do you think we should go ahead and apply and if so when?

I was and am(?!) planning on doing some supply work come September/October and was planning on applying end of Oct/November.

Just worried whether the ECO will comment on the fact that i dont and wont actually have any real income from employment coming in and s/he may question the generosity of my family.

Any advice would be appreciated.

Thanks

Forgot to mention, i will be entitled to receive Maternity Allowance which is about £440.00 per month. I will only start to receive this once I have stopped worked.

Will this be classed as a public fund?

Thanks
