Bailiff notice of removing house things of someone

Post by cool mind » Fri Jul 25, 2014 8:11 pm

A question for my friend who searched a room on internet and recently moved there with all inclusive in rent. But he found a letter hand delivered by bailiffs at door in the name of someone neither he lives there nor knows him . Bailiffs written in letter that this person need to contact in 24hrs otherwise the things will be taken away by them. Under these circumstances what can be happened with those who just moved in property as whether their luggage or things can also be touched by bailiffs if they come. What type of things they take or its just verbal threat???

If he isn't the person named on the bailiff's letter (and can prove it) they will not be able to remove any of his possessions. He should call the number given in the letter and explain the situation.

Thanks casa for answering. What he scared that if he is on work or not home and they come then they may touch his things. I also heard that these bailiffs are like fighters like club bouncer who can even fight because their duty is recovery. If they are aggressive then can the police be called or police cannot come if bailiffs involved.

A baliff can only make peaceful entry this cannot force entry. Hence do not let anyone in the house and try to keep windows shut if on the ground floor.

Write to the Bailiff and explain that the person is not residing there and for them to stop the threats.

But if they become aggressive or speak bad then can the police be called for help or police cannot be called.

In uk the properties are many 100 years old with addresses and continue to be occupied from time to time with different tenants having varying behaviors, some honest and some dishonest. In now a days many tenants not care about paying their bills especially when left the property and the same trigger the need of bailiffs who are like human not machines/spirits. I think they cannot take away things because doing that is a crime and even favorable for the things owner to ask excessive compensation of their things and that mistake they can never do. Showing them some picture id can satisfy them and if they aggressive then police can be called but i think they will come by that time when they will be gone because whenever the police is being called then they always ask the nature/type of problem and for that matter be frankly they will hesitate.

As you've already been advised, your friend can prevent a visit from the Bailiffs if he telephones the contact number he has been given. Since April 2014 Bailiffs are no longer allowed to enter through an open window. They can however, enter through an unlocked door.
