British Citizenship Question

Hello there,

I would like to ask if it is possible to get British citizenship if my mother has British citizenship.

I have been born in 1979 December

I went to British embassy and they gave me a form to fill and a copy of instructions in which I have read that my mother should be a British citizen before my birth; however, my mother born in UK and traveled with her parents to outside UK, then after in year of 2000 she applied and got the British citizenship by birth (after my birth).

So, is the amendment of the British Nationality Act 1981 still applying in my case? is it still possible for me to be British citizen?

What is your current nationality?
What was your mother's nationality before acquiring British citizenship? When was she born?

I suggest you read the following link to get an understanding of British nationality law:

As your mother was born before 1983 in the UK she would have automatically been a British citizen regardless of what nationality her parents were at the time of her birth based purely on the fact that she was born in the UK. The only exception to this would be if her parents were diplomats.

So, assuming her parents were not diplomats, your mother was ALWAYS a British citizen from the time of her birth. I suspect that in 2000 your mother simply received confirmation that she was a British citizen and did not actually apply for British citizenship. She could not have applied for it because according to British nationality law she has always been a British citizen since her birth.

Now this obviously means that your mother actually WAS a British citizen at the time of your birth. There is now a new rule in effect since 30 April 2003 that a person born outside the UK to a British mother is entitled to register as a British citizen by decent if they were born between 8 February 1961 and 31 December 1982.

This means that it should be possible for you to register as a British citizen.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

As others have said you appear to be eligible for registration as a British citizen.

What's your existing nationality? Do you know if you will be allowed to keep it or not? Or maybe that's not important?

I applied for British citizenship and yes Dawie was absolutely right, I got my citizenship as per the amendment of Act 1981.
