Extending spouse visa - FLR (M) and other questions.

Hi Everyone,

Back in 2012 my wife was granted a spouse visa at the end of June, so this was before the new rules came into effect.

Circumstances

1. Personal reasons. My wife is a BNO Passport holder (Hong Kong). She was granted a 27 month spouse visa. However, since she had a good job in Hong Kong and wanted to make enough money so that we could have a good future and buy a house, she did not arrive until the following year. She was also in the process of having driving lessons over there to get a licence she could convert here under the scheme the DVLA has for people who have passed a test in Hong Kong, but the exam was not until May 2013 (the system in HK means there can be a waiting list for that after your lessons have finished and my wife didn't want to waste all the money she had put into lessons and miss doing the test).

2. Employment Reason. She had to give notice for leaving her job and so she arrived here towards the end of August 2013, leaving 11 months left on her spouse visa which runs out at end of Sept 2014. Within 2 months she got a job and has been in a full time post since December 2013 and continuing at this time.

3. Partner circumstances. For myself, am in receipt of DLA at the low rate mobility and middle rate care. Decided to give up upon her arrival my ESA (Support Group), Housing and Council Tax Benefits because she has a job and her own savings I assume count as shared even though they are not in my name. DLA is my sole income. My wife pays some of our bills (such as food) and I pay rent and council tax out of the DLA. Have a monthly direct debit going out of my account to pay my house-mate money since all the utilities (electric, gas, water, cable TV) are in his name. House-mate and I have the habit of settling up outstanding differences at the end of each year around August time.

Questions

Would like to be sure what sort of FLR to apply for now since I last looked at the Home Office website a long time ago, downloaded a form for FLR(M), but when I checked things looks like there have been some changes and the form is much longer, so just want to make extra sure we get the right form and clarify some points since the form seems to ask for more stuff than before.

Assuming this qualifies as a straightforward case (any ideas?), probably going to use the premium service which presumably requires a face to face meeting at one of their offices. Should be no problem as there is one not far from us.

Will my wife need to take another English test? She already did one and the results were accepted for the spouse visa application.

Will we need to show adequate accommodation all over again? We got a certificate for that and was accepted for the spouse visa application and we are living in the same place.
