Tier 2 Change of Employment

Post by begoodiwse » Mon Jul 07, 2014 1:42 pm

Hello Experts,

Currently, I am working in Tier 2 General, I have been offered job and company also agreed to sponsor me,
They did RLMT and assigned CoS.

Questions:

1.Let us say, for ex, I will be granted Visa on 14th July to work with new employer. After that, I will issue resignation(after getting BRP) to my old employer and honor 1 month notice period. So, Start date for the new employer will be 14th Aug, I thought of having 2 - 3 buffer days to join with new employer. So, When I resign current job and last day of working with my old company will be 14th Aug, and If I say, I got the start date with new employer 18th Aug (as per the start date in CoS, if they mention), There is a Gap of 3 - 4 days.
Will that be a problem?
What would be my immigration status would be?
How would people generally take care of this kind of situation?
Is there any link that I could refer - I tried to find one, but I could not.

2. Maintainance

As new employer has certified that he would take care of maintenance fund? Is there I need anything apart from this?
Also, Can I use this for dependant?

I read some where in Tier 2 Policy guidance, that if we have satisfied all these requirements in the previous Tier 2 General Visa, then we don't need to provide again, But this time , I am applying for Tier 2 General Visa for different employer

3.Supporting documents
1. Application form
2. 2 photo
3. Maintenance requirement is satisfied in CoS
4. English Test - I have UK degree and also provided the same in the previous Tier 2 General Visa application(satisfied in previous application)
5. Tenancy agreement
6. Marriage letter for subsistence relationship - Do we need to provide again, as we have satisfied this in the previous Tier 2 General Visa application
7. Council tax letter - confirming both names
8. Job offer letter - Do we need this?

Please do let me know if I need to send other documents? I will be applying with depedant(wife)

I have tried to search everywhere on the web and also in this forum, but I could not find specific reply,

Experts, Please do let me know your thoughts, and suggestions, If I need to take any more documents

Regards
Ganesh

Your actual last date for the first job should be earlier than start date on CoS for new job, or the end date on BRP of your first job. Thus, as long as your fist BRP is valid until 17th August (which I assume it is) you can choose to work or not work for the first employer.

Your actual start date for the new job should not be earlier than the start date on CoS for new job.

Yes. You need the maintenance by employer mentioned on your CoS for your application and a letter from employer to cover your dependent for their application. Read the policy guidance for dependents.

Maintenance is satisfied by your already being a Tier 2 worker. There is no maintenance requirement for those changing employers.
